GENERAL TERMS AND CONDITIONS OF USING EASTPOLEPADDLES.COM E-SHOP

  1. General

1.1 These terms and conditions (hereinafter the Conditions) govern the conditions of use of the online shop located on website www.eastpolepaddles.com (hereinafter the EastPole e-Shop) and purchase of the goods provided therein (hereinafter the Products). The owner and operator of the EastPole e-shop (hereinafter the Seller) is East Pole OÜ (address is Pärnu County, Pärnu City, Estonia, Haraka Street 46, 80023, Commercial Registry Number 10838721, e-mail: info@eastpolepaddles.com).

1.2 The Clients of the EastPole e-shop can be:

a)private persons with full legal capacity (at least 18 years of age)

b)legal entities

1.3 By placing an order in EastPole e-shop, the Client confirms that:

  1. a) personal data submitted by him/her is correct
  2. b) the Client has full legal capacity
  3. c) the Client has read the Conditions and Privacy Policy, accepts and follows them.

1.4 Beside these conditions, the legal relationship between the Client and the Seller arising from the use of the EastPole e-shop is governed by laws applicable in the Republic of Estonia.

 

  1. Pricing- and product info

2.1 All product photos in EastPole e-shop have an illustrative meaning.

2.2 All prices in EastPole e-shop are expressed in euros and include VAT (Value Added Tax).

2.3 The prices of the Products in EastPole e-shop may change at any time and without prior notice. If prices have changed in time between placing an order and  the delivery of the Goods, the prices applicable at the time of placing the order shall remain valid.

2.4 Additional cost for transport shall be displayd in Shopping Cart, after the Client has chosen the delivery method.

2.5 The Seller has the right to withdraw from a Sales Contract entered into via EastPole e-shop and not to hand over the Products in the following events:

a)the Products are out of the stock

b)the Products have an ‘On order’ status in EastPole e-shop but the Products are out of producer’s stock, the Products have went out from producers’ product range etc.

c)the price or qualities of the Goods have been displayed in the e-Store incorrectly due a system error.

 

  1. Purchasing process in EastPole e-shop

3.1 Adding the Products to Shopping Cart. To start the purchasing process, the Client selects the Products from EastPole e-shop and adds them to the Shopping Cart.

a) Adding Products to the Shopping Cart does not obligate to buy.

b)The Client can change the quantity of Products in the Shopping Cart and remove Products from the Shopping Cart prior submitting the order.

c)Until submitting the order, the Products in Client’s Shopping Cart are also available to other clients. To confirm the selected Products and to continue the purchasing process, press the Checkout button.

 

3.2 Submitting personal information. If the Client has already an account in the EastPole e-shop, logging in with the account fullfills automatically the personal data fields. To place his/her first order in EastPole e-shopt, the Client must fill the personal data sheet. Information required: full name, full address including the zip code, phone number and e-mail address. The processing of the personal data is regulated by the Privacy Policy of the EastPole e-shop and applicable laws.

 

3.3 Delivery method.

  1. a) All deliveries will be made by UPS.
  2. b) EU, USA (continental) and Canada: For purchases in excess of € 150 transport is free of charge. For purchases in an amount less than € 150 the cost of transport is € 30.
  3. c) Delivery costs to addresses outside EU, USA and Canada will be evaluated case-by-case so please contact us info@eastpolepaddles.com before submitting your order.

 

3.4 Choosing the payment method. It is possible to pay:

  1. a) Via standard bank transfer
  2. b) With the credit card
  3. c) PayPal

Payments via bank link and credit card payments are intermediated by EveryPay AS. Payments take place outside of EastPole e-shop platform in safe environment – in case of bank link payment in the secure environment of corresponding bank, in case of credit card payment in safe environment of EveryPay AS. The Seller has no access to the Client’s bank- or credit card data. The controller in charge of Clients’ personal data gives neccessary data for completing the payments to  EveryPay AS.

 

3.5 Placing an order. To complete the purchase, click on the button “Place order”. The purchase confirmation of your order will be sent automatically to your e-mail address.

3.6 Making the payment according to the chosen payment method.

3.7 Delivery of the goods according to the chosen delivery method. Standard delivery times for Estonian orders are 3-5 working days, for international orders 5-10 working days.

 

  1. Widthdrawal from order, return of the Products

4.1. If the Client is a private person, he/she has the right to withdraw from the order entered into in the EastPole e-shop without providing a reason within 14 days.
4.2. If the Client wishes to return the Products, he/she must send the corresponding request with his/her data and current account number to the e-mail address info@eastpolepaddles.com.
4.3. In case of returning the Products, the Client shall send the Products to the Seller immediately, but not later than within 15 days of making the corresponding request. Returnable Products must be unused and in original packaging.

4.4 Direct costs of returning the Products shall be covered by the Client.

4.5. The Seller shall transfer the money back to the Client’s account for the returned Products as soon as possible, but not later than within 15 days from the receipt of the returned Products.

 

  1. Non-compliance with the terms of sale

4.1. The Seller is liable for the non-compliance of the Products sold to the Client with the terms of sale, which existed at the time of the delivery to the Client within two years from the date of delivery of the Products.
4.2. In case of non-compliance with the terms of sale, the Client must submit a complaint to the e-mail address info@eastpolepaddles.com. The claim must include the Client’s name, contact phone number, order number and exact description of the non-conformity of the Products. The Client has the right to submit the complaint no later than 1 month after the defect has occurred. The Seller will review complaints and respond to the Client as soon as possible, but not later than within 15 days of receipt of the complaint.
4.3. The Seller shall not be liable for the following:

a)for the deterioration of/damage to the Goods by the fault of the Purchaser

b)for the defects caused by the irregular use of the Goods

c)for the normal wear and tear resulting from the regular use of the Goods.

5.4 If such defects or shortages appear on the Product that the Seller is liable for, the Seller shall repair or replace the Product or otherwise compensate the shortage to the Client.

  1. Principles of data protection and processing

6.1The Seller shall ensure the protection of the Client’s data (including their personal data), and the use of the data following the terms of the EastPole e-shop’s Privacy Policy and appliccable laws. The Seller has the right to process Client’s data without the consent of the Client to the extent necessary for the use in the EastPole e-shop and fullfilling the Sales Contract. Based on the above, the Seller is, without the Purchaser’s separate consent, also entitled to send the Client notices related to the use of the services in the EastPole e-shop, including such notices that are in the interests of the security of the EastPoel e-shop users.

6.2 If the Purchaser has granted their consent for the use of their data for marketing purposes, the Seller shall use these data subject to the terms and purposes set forth in the Privacy Policy, including for sending personal direct marketing, campaign and discount offers for goods and services to the Purchaser electronically (e.g. by e-mail or text messages).

6.3 The Purchaser is entitled to withdraw their consent for the use of their data for marketing purposes at any time by sending a corresponding e-mail to info@eastpolepaddles.com, or to decline further direct marketing offers by following the instructions in a direct marketing offer sent to their e-mail address.

 

  1. Limitations of the Seller’s liability

7.1 The Seller is not liable for the non-delivered or delayed shipment caused by the inaccurate or incorrect data submitted by the Client.

7.2 The Seller is not liable for the delays in deliveries caused by circumstances that the Seller can not control or affect.

7.3 The maximum aggregate liability of the the Seller is limited to total amounts the Client actually paid for the Products.

 

  1. Disputes

8.1 Disputes between the Seller and the Client, arising from the use of EastPole e-shop, are resolved through the negotiations.

8.2 If the dispute cannot be resolved by negotiation, the Client may contact the Consumer Protection and Technical Regulatory Authority (Pronksi 12, 10117 Tallinn, www.ttja.ee) for advice or explanation. In order to resolve disputes, the Purchaser may address the Consumer Disputes Committee (acting at the Consumer Protection and Tehcnical Regulatory Authority).
